Terms of Service

These terms are an agreement between you and Frankie Ventures LLC(“EverTend”, “we”, “us”) covering your use of the EverTend app and website. By creating an account or using the service you agree to them. Our Privacy Policy explains how we handle your information and is part of these terms.

What EverTend is

EverTend is a tool that helps families coordinate care for a loved one: shared medication logs and reminders, appointment recordings and summaries, a document vault, tasks, and an assistant that answers questions from your family’s own record.

What EverTend is not

EverTend does not provide medical advice. Summaries, interaction checks, and answers from the assistant are generated by software and can be wrong or incomplete. They are meant to help you keep track and ask better questions, not to replace a doctor, nurse, or pharmacist. Always confirm medication changes and health decisions with a licensed professional.

Reminders are a convenience, not a guarantee. Notifications depend on your phone, its settings, and its network. A phone that is off, silenced, or out of battery will not ring. Do not rely on EverTend alone for a dose where a missed reminder could cause harm.

EverTend is not for emergencies. If someone needs urgent help, call your local emergency number.

Who can use EverTend

You must be at least 18 years old and able to enter into a binding agreement. You are responsible for keeping your sign-in credentials secure and for everything that happens under your account.

Your family and what you share

When you create a family, you become its admin. Anyone who joins with your invite code can see the family’s care record. You are responsible for who you invite and for the permissions you give them. Share invite codes only with people you trust with this information.

By entering information about another person, including the person you care for, you confirm that you are permitted to do so. Before recording a medical appointment, get the consent of everyone present, as required by the laws where you are.

Your content

Everything you add to EverTend stays yours. You give us permission to store, process, and display it as needed to run the service for you and your family, including sending the pieces described in our Privacy Policy to the AI providers that power specific features. We do not claim ownership of your content and we do not use it to train AI models.

Acceptable use

  • Do not use EverTend to store information about people who have not agreed to it, outside of your own family’s caregiving.
  • Do not attempt to access another family’s data, probe our systems, or interfere with the service.
  • Do not upload content that is unlawful or that infringes someone else’s rights.
  • Do not resell or repackage EverTend.

Free plan and EverTend Plus

EverTend’s free plan includes a monthly allowance of assistant questions, appointment recordings, and document uploads. EverTend Plus removes those limits for your whole family.

  • Plus is a subscription billed through the Apple App Store to your Apple account. Prices are shown in the app before you subscribe.
  • Subscriptions renew automatically until you cancel. You can cancel at any time in your device’s subscription settings, and access continues until the end of the paid period.
  • Refunds are handled by Apple under its policies. We cannot issue refunds directly.
  • We may change the free plan’s limits or Plus pricing. Price changes never apply to a period you have already paid for, and we will tell you before a change takes effect.

Ending your account

You can delete your account from Settings at any time, and the app will offer to export your family’s record first. If you are the last admin of a family with other members, the app will ask you to name a new admin first. We may suspend or close accounts that break these terms or that put other users at risk. We will give notice where we reasonably can.

Changes to the service

EverTend is under active development. Features may change, and we may add, alter, or retire parts of the service. You can export your family’s whole record from Settings at any time. If we ever discontinue EverTend, we will give you reasonable notice so you can do so.

Disclaimers

EverTend is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that its AI-generated output will be accurate.

Limitation of liability

To the fullest extent the law allows, Frankie Ventures LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, health outcome, or missed dose arising from your use of, or inability to use, the service. Our total liability for any claim relating to EverTend is limited to the amount you paid us in the twelve months before the claim arose, or one hundred US dollars, whichever is greater. Some jurisdictions do not allow these limits, so they may not apply to you.

Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction.

Changes to these terms

We may update these terms from time to time. If a change is significant, we will update the date at the top and let you know in the app before it takes effect. Continuing to use EverTend after that date means you accept the new terms.
